Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the https://www.accessmorepropertymanagement.com/ website and the https://www.accessmorerealty.com/ website (collectively, the “Websites”) operated by Carmuniccio, LLC DBA Access More Realty & Access More Property Management, an LLC (Limited Liability Company) formed in Ohio, United States (“us”, “we”, “our”). Your access to and use of the Websites is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, tenants, landlords, applicants, prospects, and others who access or use the Websites.

By accessing or using the Websites, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have our permission to access or use the Websites.

1. Use of the Websites The Websites provide information about our real estate brokerage and property management services, including property listings, leasing information, maintenance requests, payment portals, tenant portals, owner portals, and related resources. You may use the Websites only for lawful purposes and in accordance with these Terms.

You agree not to:

Use the Websites in any way that violates any applicable federal, state, or local law or regulation.
Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Websites, servers, or networks connected to the Websites.
Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Websites, or which may harm us or other users.
Use any robot, spider, crawler, scraper, or other automated means to access the Websites for any purpose without our express written consent.

2. User Accounts and Security Certain areas of the Websites (such as tenant portals, owner portals, or payment systems) may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Property Listings and Information All property listings, photos, descriptions, pricing, availability, and other information on the Websites are provided for general informational purposes only and may change without notice. We make reasonable efforts to keep information accurate and current, but we do not warrant the accuracy, completeness, or reliability of any information on the Websites. You rely on such information at your own risk.

4. Leasing and Applications Submitting a rental application or entering into any lease agreement through or facilitated by the Websites does not create a binding lease until a fully executed lease document is signed by all parties. All applications are subject to approval, screening, credit checks, background checks, and verification in accordance with our standard procedures and applicable law. We may use third-party service providers to process, verify, or facilitate rental applications, background checks, credit reports, identity verification, or other screening services. By submitting an application through the Websites, you authorize us and our third-party providers to access, collect, use, and share the information you provide as necessary to perform these services. You acknowledge that such third-party providers operate under their own terms of service and privacy policies, which you should review independently. We are not responsible for the acts, omissions, or data handling practices of these third-party providers.

5. Payments If you make payments through the Websites (rent, fees, deposits, security deposits, application fees, etc.), you authorize us to charge the payment method you provide. You are responsible for ensuring sufficient funds are available and for any fees charged by your financial institution or card issuer. We use third-party payment processors and gateways (such as Stripe, PayPal, or other integrated services) to handle payment transactions securely. By making a payment on the Websites, you agree to be bound by the terms and conditions and privacy policies of these third-party payment providers, in addition to these Terms. We do not store full payment card details on our servers; such information is processed and stored by the third-party processor in compliance with applicable payment card industry standards (e.g., PCI DSS). We are not liable for any errors, delays, interruptions, or security incidents related to the third-party payment services. You agree to resolve any payment disputes directly with the third-party processor where appropriate, subject to our dispute resolution procedures.

6. Intellectual Property The Websites and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Websites for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of the Websites without our prior written consent.

7. Third-Party Links and Services The Websites may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You access them at your own risk.

8. Limitation of Liability To the fullest extent permitted by law, in no event shall we, our officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Websites; (ii) any conduct or content of any third party on the Websites; (iii) any content obtained from the Websites; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Indemnification You agree to defend, indemnify, and hold harmless us and our officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from your use of and access to the Websites, or from your violation of these Terms.

10. Termination We may terminate or suspend your access to the Websites immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

11. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Franklin County, Ohio.

12. Changes to Terms We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Websites. Your continued use of the Websites after such changes constitutes your acceptance of the revised Terms.
